These Terms of Service ("Terms") govern your use of the BookATruck platform operated by BookATruck (bookatruck.com) ("BookATruck," "we," "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
BookATruck is a freight brokerage platform that connects shippers ("customers") who need freight moved with motor carriers ("carriers") who move it. We arrange transportation as a broker; we are not the carrier and do not ourselves transport freight.
2. Accounts
You must provide accurate information and keep your login credentials confidential. You are responsible for all activity under your account. Notify us immediately of any unauthorized use. Accounts are for business use by users 18 or older.
3. Acceptable use
You agree not to misuse the Service, including: submitting false shipment or carrier information; shipping illegal, hazardous, or prohibited goods without proper disclosure and authorization; attempting to access other users' data; or interfering with the Service's operation or security.
4. Bookings, quotes & pricing
Prices and quotes shown in the app are estimates based on the information provided and may change based on actual distance, weight, stops, accessorials, or market conditions. A booking is an agreement to arrange transportation at the agreed rate. You are responsible for the accuracy of pickup/delivery details and for goods being ready as described.
5. Payments
Customers agree to pay the charges for loads they book, per the invoice or statement provided. Carriers are paid the agreed rate for completed loads, subject to our freight-audit process. Late or unpaid balances may result in suspension of the Service.
6. Carriers
Carriers are independent contractors, not employees or agents of BookATruck. Carriers represent that they hold valid operating authority, insurance, and licensing required to perform each load, and will maintain them. Carriers are responsible for safe, lawful, and timely transportation and for the freight in their possession.
7. Estimates, tracking & availability
Distances, ETAs, and GPS tracking are provided for convenience and are not guaranteed. The Service is provided on an "as is" and "as available" basis, and may be unavailable at times for maintenance or reasons beyond our control.
8. Cargo claims
Claims for loss of or damage to freight are generally the responsibility of the carrier that transported the shipment, subject to applicable law and the carrier's liability limits. We will reasonably assist in directing claims to the responsible carrier.
9. Disclaimer of warranties
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that estimates will be accurate.
10. Limitation of liability
To the fullest extent permitted by law, BookATruck will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of your use of the Service. Our total liability for any claim relating to the Service is limited to the amount of brokerage fees you paid us for the load giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless BookATruck from claims, damages, and expenses arising from your use of the Service, your shipments, or your breach of these Terms.
12. Termination
You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk. Provisions that by their nature should survive termination (payment, disclaimers, liability limits) will survive.
13. Governing law
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Minnesota.
14. Changes
We may update these Terms from time to time. We will post the new version here and update the date above. Continued use of the Service means you accept the updated Terms.
